What is Social Security Disability?

A Social Security lawyer has a copy of a Social Security card.Social Security Disability is called by a lot of different names. It’s known as SSD, SSDI, DIB, and Title II.

Social Security Disability Insurance (PDF) is a government program, which is designed to pay people who cannot work anymore because they have become disabled. The program is funded by the federal income tax. In the United States, when you work, you earn “work credits” with the Social Security Administration. The system rewards hard working Americans who want to work, but can’t anymore. It’s not limited by your income and there is no limit to the amount of money that you can receive from Social Security Disability.

Types of Disabilities:

What is Supplemental Security Income (SSI)?

Supplemental Security Income is for people who are blind, over 65 years old, or disabled as determined by the Social Security Administration, but who have not worked enough to qualify for Social Security Disability. This system is in place for people who have very little income, and cannot earn more because they are disabled. With Supplemental Security Income, there is a limit to the amount of money you can receive.

What is the Fee?

Our fee is the industry standard 25% of your past due benefits (and we won’t ever charge you more than $6,000), and we only charge you if we win your case and you receive past due benefits.

How Do I Qualify for Social Security Disability?

A Social Security lawyer has a document labeled: "Social Security Disability Claim" that has a red stamp on it labeled: "Denied."In order to qualify for Social Security Disability, you need to meet two criteria:

  1. You need to have at least one disability, as they are defined by the Social Security Administration; and
  2. You have to have worked and paid income tax for 5 out of the last 10 years.

The first criteria is the most difficult to prove, and that’s why you should consider hiring an experienced Massachusetts Social Security Disability lawyer. The Social Security Administration doesn’t like to award everyone right away because it would be too expensive for them. They want applicants to show them that they are disabled. That means providing medical records and statements from doctors and other medical professionals. It can be really difficult to obtain that information without a lawyer because you might not know exactly what to look for. Social Security Disability lawyers will sift through hundreds of pages of medical records to get exactly what you need to win your case.

What Kinds of Disabilities?

The most common types of disabilities in Massachusetts are arthritis, back and spinal cord injuries, and mental disorders. Other qualifying disabilities include, but are not limited to:

  • Anxiety.
  • Asthma.

How to Apply for Social Security Disability?

You can apply for benefits on your own from the Social Security Administration website. You should apply as soon as your doctor believes your disability or illness will prevent you from working for more than one year. For your application, you will need medical records and reports to verify that you have a legitimate disability or impairment which qualifies you to receive benefits.  Read more.

The Social Security Disability Application Process:

Most applicants are denied the first time they apply for benefits. After you get denied, you have the option to reapply, called reconsideration. The vast majority of reconsiderations are also denied. After you get denied again, you can file an appeal so that a Judge will review your case and decide whether or not you will be awarded.

The Judge’s decision is final. It can sometimes take a long time to get a hearing from a Judge, and that time is critical to the success of your case. A lawyer will walk you through the process step by step and ensure that you have the strongest case possible when you go in front of the judge.

What is My SSD Case Worth?

In 2013, 868,965 people received Social Security Disability Benefits, and they averaged $1,222 per month. Social Security Disability Benefits are in part calculated by the amount of money you earned while working. They can also be affected by other benefits you receive, whether you have medical insurance, and whether you have children.

What Are Long Term Disability (LTD) Insurance Benefits?

If you have Long Term Disability Insurance (also known as LTD) and you have an injury or illness that affects your ability to work, you may be entitled to disability benefits through your insurance policy. The right attorney can help you recover the maximum amount of benefits entitled to you.  Read more.
