Atrium C-Qur MDL

After multiple cases were filed against Atrium Medical in connection with injuries alleged to be caused by its C-Qur hernia mesh patch, the U.S. Judicial Panel on Multidistrict Litigation consolidated all Atrium C-Qur lawsuits in the District of New Hampshire. This means that the cases will proceed forward through initial discovery phases together for the convenience of the parties involved. Cases had been filed against Atrium in multiple states including Arizona, Florida, Georgia, Kansas, Mississippi, and a total of 8 cases filed in New Hampshire to name a few. What are the C-Qur Lawsuits Alleging?

Litigants also allege that Atrium knew of the grave dangers and failed to warn doctors or patients of the risks. Many of the complaints allege that even after Atrium sent a letter to surgeons advising them to check the C-Qur devices for packaging defects, the company failed to take the defective mesh products off the market and continued to heavily market the patches as safe and effective. The complaints further allege that as a result of being treated with the defective mesh products, patients experienced painful, long-term side effects that severely impacted their lives.

Why is the C-Qur Causing Injuries?

It appears as though there was a design flaw that may have led to the C-Qur mesh products becoming prone to deteriorate if stored under certain conditions. The C-Qur contains a light layer of fish oil coating that is intended to make the mesh easy to place on a patient’s skin. However, it was later shown that this layer was be insufficient to adequately protect the packaged product from exposure to heat and/or humid conditions, thus causing damage to the mesh patch and making it dangerous for use. The patches have been shown to cause a higher than expected number of physical side effects such as chronic pain, adhesions, and allergic reactions. There have also been a higher than expected number of recurring hernias after treatment with the C-Qur requiring additional surgeries to replace the patch.
