Mirena IUD is a long-acting reversible contraceptive device manufactured by Bayer. Bayer has been criticized for it’s marketing of Mirena IUD. Specifically, the company’s “Simple Style Campaign” resulted in a Food and Drug Administration (FDA) warning because it misled consumers, failed to include information about side effects, and lied about Mirena IUD’s routine uses. Drug and medical device manufacturers have a duty to provide reasonable warnings and instructions for their products. Here, Bayer’s marketing has misled consumers, preventing consumers from making an informed choice about Mirena IUD. Bayer has routinely minimized the risks surrounding Mirena IUD. These risks include uterine perforation, pelvic inflammatory disease, amenorrhea, and pain and cramping. Mirena IUD can cause these serious injuries by becoming dislodged or shifting in the uterus.
Mirena IUD Lawsuits
In New Jersey, Bayer has moved to consolidate 16 Mirena IUD lawsuits filed in Middlesex County, New Jersey. Additionally, an Indiana woman filed a lawsuit after she suffered permanent physical injury from Mirena IUD. Specifically, the medical device shifted her abdominal wall. The injury required her to undergo laprascopy surgery. Lawsuits against Bayer alleging the company failed to provide adequate warnings and instructions have seen a nationwide increase with filings in both state and federal courts. The growing mass of evidence shows that Mirena IUD is not as safe as Bayer has advertised. As of June 30, 2012, the FDA has received 45,697 reports that Mirena IUD has caused unfavorable side effects. This new wave of contraceptive lawsuits against Bayer follows the numerous Yaz lawsuits the company has settled in the past year. As of July, 31, 2012, Bayer has paid over $402 million to settle Yaz lawsuits. These Mirena IUD and Yaz contraceptive lawsuits are a cautionary tale for all drug and medical device manufacturers that engage in misleading advertisement.
