Propecia and Proscar are two drugs, both manufactured by Merck & Co., Inc., that treat male pattern baldness by altering the patient’s hormone levels. In 1997, the Food and Drug Administration (FDA) approved Propecia for sale on the market. Propecia has since been linked to possible sexual side effects which may include decreased libido, ejaculation disorder, testicular pain, and erectile dysfunction. Other alleged side effects associated with use of the drug may include headache, nausea, depression, and in some rare cases male breast cancer.

Between 1998 and 2011, the FDA received 421 reports of adverse consequences from patients taking Propecia. According to the Journal of Sexual Medicine, Propecia’s side effects may persist for months or years after discontinuing use of the drug. While Merck had included some warnings about the sexual side effects of Propecia, the warning label did not include information about the drug’s persistent or permanent sexual side effects until April 2012. This means that for the first four years the drug was sold on the market it did not adequately warn its users of the drug’s adverse consequences. This failure to warn may give rise to a valid legal claim.

In the past year, Propecia lawsuits have become so numerous that the Propecia claims have been consolidated into a multidistrict litigation (U.S. District Court, Eastern District of New York, MDL 2331 – IN RE: Propecia (Finasteride) Products Liability Litigation). According to Merck’s third quarter report, 265 lawsuits have been filed against the company naming 415 plaintiffs. The plaintiffs will be seeking compensation for the injuries they have suffered and will continue to suffer. A number of patients injured by Propecia will have to receive hormone treatment for the rest of their life.
