Denied Social Security Disability Claim from a Taunton man

The attorneys at d’Oliveira & Associates recently obtained a significant award for a Taunton client whose case was brought before the Social Security Administration. The client (whose name is withheld for confidentiality purposes) had become unable to work after a cancer diagnosis required surgery and related treatments. Although successful, the treatment resulted in conditions such as continued pain in both of his hands and feet, neuropathy, and exhaustion. Unable to return to work, the client applied to the Social Security Administration for disability support but was subsequently denied.

According to the complaint, the client sought the assistance of experienced Social Security Disability attorneys in order to re-apply for benefits and has since received nearly $25,000 in retroactive benefits and will receive an additional $1,770 a month in support. After contacting the law offices of d’Oliveira & Associates, Attorney Cara Gallucci was able to win his case and did not charge him a fee until he had received his back due benefits.

Attorney Paul d’Oliveira stated that “Attorney Cara Gallucci and her staff did an excellent job in winning this case and getting such a nice award for this Taunton man. It is heartbreaking to see someone fight cancer as it is such an awful disease. It is unfortunate that this case took as long as it did for Cara to win this case as the Government should put people, who are clearly disabled, on the SSD benefits they paid for much sooner.”

Although a diagnosis of cancer typically forces a person to leave work in order to pursue avenues of treatment, it does not automatically qualify a person for Social Security Disability benefits. The Administration is typically hesitant to award benefits when there is a chance of an applicant’s health improvement because the purpose of giving out benefits is to support those who are totally disabled and cannot return to work. However, just because there are several forms of cancer treatment and persons suffering can, and often do, go back to work, there are cases where the treatment itself can leave a person unable to go back to work. Often, extensive cancer treatment, such as chemo-therapy, can significantly reduce a person’s functional capacity for work. Additionally, when a person has been determined to have been disabled for over two years, they may qualify for additional Medicare benefits. This is why is it important to hire an experienced Social Security Disability attorney that can help you explore your options and guide you through the complex process of obtaining the disability benefits you are entitled.
