The personal injury and auto accident attorneys at d’Oliveira & Associates recently recovered a settlement including $100,000 in basic insurance coverage and then another $100,000 in underinsured motorist coverage for one of its clients. According to the complaint, the plaintiff was injured when a negligent and underinsured motorist collided with the client’s vehicle over two years ago.

According to the complaint, the client was initially admitted to the hospital and treated for pain and severe strains throughout her back and neck; however, over the course of several months, the pain continued to worsen. Several months after the accident she was diagnosed with a left paracentral disc protrusion and after two years of multiple trips to the emergency room and doctors’ offices with complaints of extreme pain and numbness, all while undergoing various forms of physical therapy and injections that were having no effect according to the complaint. The client finally agreed to undergo back surgery; it took two years for the client to finally see improvement from the injuries sustained in the accident, she still has some residual pain and is limited in her daily abilities.

The client contacted the auto accident attorneys at the law offices of d’Oliveira & Associates. Attorney Robin Gouveia was able to get the insurance companies to settle the client’s claims and did not charge her a fee until she received the settlements.

Attorney Robin Gouveia stated, “[W]e submitted a demand for the bodily injury policy limits of the driver who caused the accident early in the case because it was clear the case was worth the limits. At the same time, we put the client’s own insurance company on notice of a claim for Underinsured Motorist because the other driver’s policy was not enough to fully compensate her for her pain and suffering. We obtained the permission to settle with the Bodily Injury carrier, as required by the insurance companies. Before the client was finally discharged, and after the BI claim was resolved, we submitted the Underinsured Motorist demand to the client’s insurer and very quickly received an offer of their policy limits.”

This case is an example of the common situation where the negligent driver either does not have insurance at all or have enough auto accident insurance to cover the other injured party’s expenses. While it may seem like this would prevent the injured party from being able to properly recover from, many insurance companies will cover the expenses that the negligent driver cannot under a procedure known as “Uninsured/Underinsured Motorist Claims.” Attorney Gouveia was able to get the negligent driver’s personal insurance company to settle the client’s case for their policy limits and then got the client’s insurance company to settle for their underinsured motorist policy limits. Because the process of determining liability, coverage and filing claims to insurance companies can be complex, it is important to hire an experienced auto accident attorney. The personal injury and auto accident attorneys at d’Oliveira & Associates can help you find out who is responsible and find an insurance carrier that will get you the compensation you deserve.
