A d’Oliveira & Associates disability attorney recently recovered an award for a Foster client (name withheld for confidentiality purposes) during his appeal for Social Security Disability benefits. The man had first applied for benefits back in April of 2012 and the initial request was denied by the Administration two months later in July of 2012. According to the complaint, the man became disabled in December 2011 having suffered chronic back problems, specifically herniated discs as well as spinal stenosis (an abnormal narrowing of the spinal canal). The man had initial visits with medical imaging specialists who performed both a CAT scan and an MRI.
Results from these diagnostic tests revealed that surgical repair would be necessary on the man’s back. The man underwent a series of three back surgeries and followed a strict schedule of taking prescription pain relievers afterwards. After having his initial filing for Social Security Disability benefits denied, he hired attorney Laura Cameron of d’Oliveira & Associates.

The man was awarded over $20,000 in past-due benefits, and qualified to receive monthly disability payments of over $2,000 going forward. A number of different back injuries, specifically disorders of the spine, may qualify an individual for Social Security Disability benefits (i). Disorders of the spine such as herniated disks and spinal stenosis are all qualifying disabilities if they can be established and confirmed by findings on appropriate medically acceptable imaging.
Individuals who have sustained serious back injuries should be proactive and seek out treatment for their condition, beginning with proper diagnostic measures such as medical imaging. Even with a positive diagnosis evidenced by x-ray, CAT scan, or MRI, applicants may still be denied Social Security Disability benefits. In spite of an unsuccessful initial application, these applicants could achieve eventual success with the help of an attorney through the Administration’s appeals process.
