In 2010, DePuy Orthopaedics, a metal hip replacement manufacturer owned by Johnson & Johnson issued a recall of the popular ASR Hip Replacements. Because the class of hip replacements subject to the recall have been used in the U.S. since 2005, DePuy estimates that roughly 10,000 users will now have to undergo an invasive and painful procedure to have the replacement hip removed. Moreover, approximately 93,000 people are said to have received the new hips over the years they were being sold.

Currently, Johnson & Johnson is facing 8000 claims over the recall. Last month, the first settlements were reached for $200,000 each after the three plaintiffs successfully proved their case against Johnson & Johnson. These are just the first of the settlements that are expected to be settled. Some 6,000 cases were already consolidated as multidistrict litigation.

Hip replacements, one of the most common types orthopaedic operations, are intended to make wonders in one’s life. By replacing hips with artificial metal joints and sockets, they restore mobility and allow people the ability to return to work and to enjoy activities. Typically, the metal hips are expected to work well for about 15 to 20 years.

Defective DePuy Hip Replacements

DePuy Hip Replacement Recall

The problem arises when the hips become defective. The most common DePur Hip Replacement injuries occur when the hips dislocate and when the wear and tear discharge metal splinters. The breakdowns destroy the tissue surrounding the replacement and in some extreme cases, cause tumors in the areas surrounding the worn metallic hip. Unmet patient satisfaction and further injuries sustained are common complaints in the class of lawsuits against the DePuy metal hip replacement manufacturer.

Complaints regarding the DePuy ASR recalls center around the high level of metal ions that are released from the hip and actual worn pieces of metal that break away can cause pseudotumors. According to The U.S. Food and Drug Administration, the Adverse Events Reports indicated the DePuy knew of these risks and occurring side effects in 2009 and failed to disclose the findings to the public.
