d’Oliveira & Associates releases our Mirena IUD Infographic on our website, which presents a brief description about the intrauterine device, the device’s manufacturer, and how the market has been misled by the manufacturer.
The Infographic shows, at a glance, how the device functions to prevent pregnancy and what its side effects are. Mirena IUD works by releasing small doses of the hormone levonorgestrel over a five-year period, preventing fertilization. Some of the known side effects include amenorrhea, cramping, ectopic pregnancy, embedment of the device in the uterine walls, irregular bleeding, ovarian cysts, pelvic inflammatory disease, and perforation of the uterine wall.
The Infographic also shows the marketing campaign from the manufacturer that had deceived consumers into using the product. For example, one of the pieces of information that was used to mislead the consumers was that the device enhances a couple’s sexual relationship. However, study shows that 50% of users have actually experienced decreased libido. Thus, the campaign has misled the consumers about the side effects and the device’s routine uses.
The Infographics page also presents a timeline, it shows that the device was approved for sale in 2000. Subsequently, in 2009, the FDA issued the false advertising warning, and in 2010, a study reported the adverse side effects for women who become pregnant while using the device. In 2012, it was discovered that around 50% of the physicians in the United States were not properly informed about the risks of the device.
On March 21, 2013, a judicial panel on multidistrict litigation (MDL) in San Diego, California was supposed to have met and decided whether to consolidate the Mirena IUD cases into a single federal court (In re: Mirena IUD Products Liability Litigation, MDL No. 2434 (JPML)).
The MDL would allow plaintiffs to more quickly get their day in court. Plaintiffs have been alleging a wide variety of side effects and the federal courts saw the need to consolidate the lawsuits, this signifies a success for the plaintiffs.
