Stryker Hip Implant Lawsuits

The Food and Drug Administration (FDA) approved Stryker’s first hip implant device for sale on the market in 2003 and approved Styrker’s Rejuvenate Modular and ABG II models in 2008 and 2009 respectively.  The Styker hip implant is a medical device where a metal ball connects to a metal socket to simulate the hip joint. Unfortunately, the metal on metal joint is corrosive and creates health problems for the patient. Serious side effects of the Stryker hip implant include pain, infection, tissue damage, bone damage, difficulty walking, broken implants, and death.

The main cause of these side effects is the corrosion of metal in the body causing the device to fail and resulting in blood toxicity. The failure of the Stryker hip implant has forced patients to undergo corrective surgery. The FDA has issued numerous warnings to Stryker about its packaging, cleanliness, and unsatisfactory manufacturing of its medical devices.  In July 2012, Stryker issued a voluntary recall of its hip implant products, Rejuvenate Modular and ABG II. The recall warned of the two products likelihood to fail.

Stryker Lawsuits

Recently, a New York judge denied Stryker’s motion to dismiss based on the statute of limitations. Stryker claimed that the three-year statute of limitations began to run in 2007 when the plaintiff first complained of hip pain. The judge ruled that the jury could find the statute of limitations began to run in 2009 when the plaintiff’s pain escalated. This case illustrates the importance of filing a legal claim in a timely manner because a plaintiff may be barred from recovery if the statute of limitations has expired. d’Oliveira & Associates has the legal expertise to evaluate your legal claim. On October 18, 2012, ten New Jersey plaintiffs moved to have their claims consolidated in New Jersey state court. Stryker lawsuits claim negligence and strict liability. Specifically, they assert defective product and failure to warn claims.
