Do I Qualify To Receive Personal Injury Protection (PIP) For My Brockton Car Accident?

If the car you were in when you sustained your car accident injury was registered in MA, personal injury protection (PIP) may be an available option for you. PIP is sometimes called  “no fault” insurance, meaning that even if you were found to be at fault in your accident, you can still claim PIP benefits from the vehicle you were in, if that vehicle was registered in Massachusetts.

PIP benefits are intended to compensate you or any other injured person in your vehicle for their medical costs, funeral expenses, and a percentage of lost income. Payment for PIP is typically capped at $8,000 per injured person. PIP may also cover the balance of your expenses not otherwise covered by the other party’s insurance company or your private health insurance. What If The Other Driver Does Not Have Insurance?

Sometimes, the other driver involved in your car accident does not have insurance, or the other driver may even flee the scene. Both of these drivers would be considered “uninsured motorists.” In these situations, you may be entitled to uninsured motorist benefits from the insurance of the vehicle you were in at the time of the accident, and insurance companies are not able to raise your rates if you were not the at-fault party. In some situations, you may even be entitled to uninsured motorist benefits from your insurance of the vehicles insured by other members of your household.

Is Insurance Liability Coverage Available For My Brockton Car Accident Case?

MA requires that every vehicle have a $20,000/$40,000 minimum coverage. The insurance company will pay up to $20,000 per injured person, and up to $40,000 total for all individuals hurt in the accident. Many car insurance holders carry more than this minimum requirement.

Under MA’s insurance liability coverage, only the insurance of the at-fault party would pay. This payment is intended to compensate the injured party for their lost income, medical costs, and pain and suffering.

  • Turn on your hazard lights and only move your vehicle if necessary to get out of harm’s way
  • Call 911 to request needed medical attention
  • For most car accidents, even if you don’t think you are injured initially, some pain does not manifest for hours or days after the accident. It is important to get checked out and seek medical help right away
  • Get the other driver’s name, address, and insurance information
  • Take photos of the scene of the accident, including the position of the cars involved and any visible injuries
  • Record the names and phone numbers of any witnesses to the accident
  • Note the position of the cars, road conditions at the time of the accident, weather, traffic violations, time, and location

What Information Should I Give My Insurance Company?

A woman reviewing insurance paperwork at her home.
  • We advise that you contact your insurance agent as soon as you can following your accident. Insurance companies may require that you file your claim within a set amount of time after an accident, so don’t wait!
  • Go through your policyLook at your insurance policy to determine what coverage you have and what claims you should file. Consult an experienced Brockton car accident attorney to help you with this process
  • Tell your insurance agent about the specific details of the accident, including the insurance information of other parties involved in the accident
  • Keep all paperwork associated with your car accident claim. This could include your medical bills, vehicle repair expense reports, and any other receipts having to do with your accident
  • We suggest against speaking with the opposing party’s insurance company unless you first speak with an experienced Brockton auto accident lawyer. If you do choose to speak with the opposing party’s insurance, know that what you say may be used to reduce your compensation, so avoid talking about the specific details of how the accident happened, do not agree to any offers until your doctor clears you, and do not sign insurance waivers until you are no longer experiencing pain.
