Transvaginal Mesh Lawsuit

It was recently reported that C.R. Bard was ordered to pay $2 million to Donna Cisson. The West Virginia jury awarded her $250,000 in compensatory damages and $1.75 million in punitive damages. Cisson filed the lawsuit after experiencing pain, bleeding, and bladder spasms which required corrective surgery. According to the article, her lawsuit went to trial for two weeks and the jury deliberated for two days. At trial, her lawyers argued that the company knew that the implants were made out of a plastic which should not be permanently implanted in humans. A spokesperson from the company stated that “we disagree with the verdict reached by the jury and believe there are compelling grounds for reversal” (i).

One week after the transvaginal mesh trial and verdict was reported that C.R. Bard reached a settlement with Wanda Queen regarding her transvaginal mesh lawsuit. In this case, Wanda Queen filed a lawsuit after she was implanted with the Bard Avaulta, which subsequently caused her to undergo six surgeries. The amount of the settlement is confidential (ii). Case name: Queen v. C.R. Bard Inc., 11-cv-00012, U.S. District Court, Southern District of West Virginia (Charleston).
