A Philadelphia jury has awarded $13.5 million to a woman who claimed that she suffered extreme pain and required multiple corrective surgeries as a result of getting a transvaginal mesh implant manufactured by Ethicon, a subsidiary of Johnson & Johnson (J&J). According to a report, the 65-year-old woman said even after undergoing the surgeries, she continued to suffer from health problems and filed a transvaginal mesh lawsuit. Jurors awarded her $5.5 million in compensatory damages and $7 million on punitive damages.

Why Did The Jury Award The Woman?

The jury awarded the woman because they concluded that the design of the transvaginal mesh was defective. During the two and a half week trial, her lawyers focused on expert testimony from J&J managers, doctors and others who worked to develop the transvaginal mesh, Prolift. They also obtained damaging testimony from a product engineer for Ethicon who said that the company had no backup plan if the implant failed. The engineer said the company had not thought of any procedure to remove the mesh if it caused problems. The testimony also revealed that the company did not warn patients that the transvaginal mesh could cause pain, even though they knew about the side effects.
