How to deal with your own insurance company?

  • Contact your insurance company to file a claim right after the accident.
  • Review your insurance policy to determine the coverage that is available to you. This way you file the proper claims. To make it even easier, our experienced Providence car accident lawyers here will guide you through this process.
  • Tell your insurance company everything they ask you. We advise you speak to us first though.
  • Get your insurance policy to determine the coverage you have available.
  • We highly recommend that you do not speak to the other person’s insurance company without speaking to a lawyer first. If you decide to talk to the opposing party’s insurance company be sure that you:
    • DO NOT disclose any information about the accident because it can be used against you and
    • DO NOT accept any offers to settle your claim until your doctor has released you from medical treatment and you are no longer in pain. There may be underlying or unknown injuries that still need to be compensated for.

What are the Most Common Causes of a Car Accident?

  • Speeding – When a driver goes above the posted speed limits, they put anyone near them, other drivers or pedestrians, at risk of being injured. Reaction times are drastically hindered when people speed.
  • Drunk Driving – Driving while under the influence of alcohol is one of the leading causes of a car accident. Over 10,000 deaths per year, which is nearly 30% of all fatal car accidents in the U.S., come as a result of drunk driving.
  • Distracted Driving – While we may first think of cell phone use as the only form of distracted driving, there are numerous other culprits. Setting a GPS, playing with the radio and being distracted by your passengers are all forms of distracted driving. If your attention is not on the road, you risks and other people’s lives.
  • Auto Defects – Design flaws and manufacturing defects are a possibility with any vehicle. Make sure you learn how your vehicle feels when it is running smoothly so you can be aware when something does not feel or sound right. Also, keep up-to-date with any recalls that manufacturers put out so you can get any issues fixed right away.
  • Driver Error – Whether it is an inexperienced new driver or a careless veteran driver, human error can cause car accidents. Poor judgment calls, over-aggression and lack of experience can all cause a driver to make a mistake that harms everyone around them.

Can I recover for property damage to my car?

It really could not be any easier to get the most money for the damages to your motor vehicle. You just need to have the insurance company look at your vehicle at an auto body shop as the repairman can negotiate the most money to fix your car. We have auto body shops to do this for you if you need us to. Read more

What insurance coverage does a RI motorist have to carry?

In RI, the minimum liability coverage that an owner of a vehicle must have is $25,000/$50,000. This means each injured person has up to $25,000 of coverage. However, if more than one person is injured, $50,000 in coverage is available for all parties injured. If there is not enough coverage you then can collect underinsurance from the car you were in and/or any vehicles owned by those in your household.

How much is the legal fee?

Our firm charges a standard 1/3 fee only if we get you a settlement to your satisfaction or award. Furthermore, we do not charge any upfront fees to get your medical records or to investigate your claim.

How to Report a car Accident in Providence, RI

You should follow these simple steps after you have been in a car accident:

  1. Call the police immediately. You may still be startled or disoriented from the accident, but as soon as you have sought the necessary medical attention, you need to report the incident. Even if the accident was a minor one, such as a fender bender, the police report helps serves as a basis for insurance companies to determine responsibility and resolve future disputes.
  2. Tell the truth, but never admit fault. There are cases where you will feel scared or even unsure of what happened, which is why it may appear to you that you are at fault even when you are not. But, it is important that you do not mistakenly admit fault on the accident report that insurance companies will use later. Even normal phrases like “I’m sorry” may be interpreted as admitting fault.
  3. Provide important information such as the time of crash, precise location, personal details of both drivers, details of the vehicles, description of the injuries, condition of the road at the time of the accident, how the crash occurred, and images of the incident. Do not sign a document unless it is the crash report.
  4. Be polite in addressing the police. The officer or officers that respond to the crash will be doing their best to determine who was at fault for the accident. The last thing that you want to do is accidentally prejudice them against you by being impolite.
  5. Document the situation in case an officer is not available. Find witnesses, and gather evidence. You need to make sure that you can provide the authorities with a detailed report. You may even record your voice narrating the events as you remember them.
