court of Biomet claim

The new Biomet Hip Replacement video released by d’Oliveira & Associates discusses some of the common and serious side effects associated with the device and what recipients of the device can do if they suffer an ailment associated with the metal-on-metal device. Common side effects associated with the Biomet Hip Replacement include pain, swelling, rash, inflammation, difficulty walking, and tissue death inside the hip.

The Biomet metal-on-metal hip implant devices were approved by the FDA in 2004. In September of 2001, the Food and Drug Administration (FDA) announced that Biomet would be implementing a recall for its metal-on-metal hip implant devices. The device at issue was the Zirconia Ceramic Femoral Head, the ball part of the device that fits into the socket. The Zirconia Ceramic Femoral Head was causing high fracture rates within 13 to 27 months after implementation, while most hip implants are supposed to last 15 years or more before requiring revision implants.

The frustration with Biomet Hip Replacement devices caused various plaintiffs to file numerous lawsuits that were eventually consolidated, by the US District Court, into multidistrict lawsuits for the Biomet M2a Magnum Hip Implants in the US District Court for the Northern District of Indiana. (MDL 2931, In Re: Biomet M2a Magnum Hip Implant Products Liability Litigation). This multidistrict lawsuit would qualify anyone that had received a Biomet M2a Magnum hip implant and had been at risk of serious and permanent injuries, particularly Metallosis. The constant rubbing between the metal components can create fragments that could be absorbed into your bloodstream and in some cases lead to bone fractures, ossification, osteonecrosis, or infection and scarring of the surrounding tissues and bone.

Attorney Paul d’Oliveira stated that “the manufacturers of these metal on metal hips all made the same mistake here by not properly testing these medical devices before mass marketing them to surgeons around the country and now many people will need to have the hip implants removed and replaced with the traditional non metal on metal hip implants. It is unfortunate that the manufacturers were more concerned with profits over patient safety. Hopefully these lawsuits will compensate the victims for their unnecessary pain and suffering.”
