Sometimes, birth injuries are the results of entirely unavoidable circumstances. The birth injuries may have occurred while the child was a fetus in the womb and, in some cases, they may result from illnesses that are very difficult to notice and that may not have responded to treatment. In other cases, however, medical mistakes that cause birth injuries end up costing a child a great deal of quality of life and a great deal of money as they age. This is why their families sometimes opt to file a lawsuit.

Cerebral Palsy

Cerebral palsy is one of the most common conditions that directly result from birth injuries. This particular condition is caused by a brain injury, oftentimes resulting from the child being starved of oxygen during the birth process. This may happen because the child’s umbilical cord ends up wrapped around their neck, strangulating them. In other cases, the birth injury may result because of a cesarean section not being given in time. In fact, multimillion dollar lawsuits have been won over cases when a woman should have been given a cesarean section but was not given one in time to avoid a child becoming injured.

Investigations

In any instance when a child is injured in the womb, during the process of being born, or shortly after, the hospital will investigate the causes of that injury. Sometimes, the investigation will come back showing that medical negligence was the cause of the injury. In other cases, it may take an attorney conducting a separate investigation to establish this.

If your child was born with an injury or suffered an injury shortly after birth, you may want to consider contacting one of these attorneys. This can be a very intimidating thing to do. Because physicians and hospitals are experts and most people are not, it can sometimes seem like you may be overreacting or completely without a legitimate basis to file a lawsuit. You should let an attorney help you to investigate whether or not this is the case.

Consulting with one of these attorneys is free. There is, however, only a limited window of opportunity to act on a birth injury claim following the incident. This is why it’s so important to contact an attorney right away. If you do not contact an attorney in time, you very well may miss your opportunity to file a lawsuit for the injuries your child suffered.
